Abhirang Intelligence LLP

Validity: These Terms apply to all users of the Abhirang platform accessing or using our

satellite imagery-based farmland intelligence APIs or any other service provided by

Abhirang Intelligence LLP ("Abhirang", "we", "us").

1. Overview and Acceptance

Company Information: Abhirang Intelligence LLP is a SaaS provider of geospatial intelligence, offering APIs for real-time farmland and agricultural analytics using satellite imagery.

Acceptance: By registering for our services, accessing our API platform, or integrating any of our tools, you confirm that you have read, understood, and agreed to be legally bound by these Terms.

Scope: These Terms govern all interactions with the Abhirang platform, including usage of APIs, dashboards, data visualizations, and developer tools.

2. Services and Eligibility

Services Provided: Remote sensing-based farmland intelligence APIs, crop classification, rainfall data, soil moisture index, NDVI reports, irrigation pattern analytics, boundary mapping, yield estimation, and similar satellite-derived insights.

API-Based Model: Services are accessed via subscription-based API endpoints and RESTful APIs under authenticated tokens issued to registered users.

Eligibility: You must be of legal age in your jurisdiction or authorized to act on behalf of your organization.

Service Modifications: We reserve the right to upgrade, add, remove, or discontinue services or APIs without prior notice.

3. Registration and API Access

Registration Requirements: All customers must complete registration via the Abhirang portal and agree to the Terms and Privacy Policy.

API Key Issuance: Upon successful KYC verification, unique API keys will be issued. Each key is tied to an account and may have rate limits.

Account Security: You are responsible for securing your API keys and access tokens. Abhirang will not be liable for breaches resulting from compromised keys.

4. Customer Responsibilities and Compliance

Compliance with Law: Users must comply with all applicable national and international laws concerning data usage, digital services, and privacy.

Permitted Use: You may only use our APIs for lawful agricultural, insurance, environmental monitoring, or commercial purposes.

Prohibited Use: You may not:

1. Reverse-engineer or modify our APIs

2. Use APIs to train AI or ML models without permission

3. Repackage, resell, or redistribute output data without license

4. Use the platform for surveillance or non-agricultural espionage

Responsibility for Third-Party Access: If you integrate our APIs into third-party platforms, you are liable for all use.

5. Billing and Payment

Subscription & Usage: Pricing is based on the number of API calls, data consumption volume, or usage tier selected. Monthly, quarterly, or annual plans are available.

Payment Terms: Invoices are due within 7 days of issue unless otherwise agreed in writing.

Overage: If usage exceeds the allocated quota, additional charges will apply at the prevailing overage rate.

Late Payments: Interest of 1.5% per month applies on overdue payments.

Taxes: All applicable taxes (GST, etc.) are borne by the customer and added to the invoice.

6. Data Usage and Ownership

Customer Data: Any geolocation or metadata you provide remains your property.

API Output Data: The satellite imagery-derived outputs remain the intellectual property of Abhirang and are licensed to the customer for agreed use cases only.

Data Retention: API logs are stored for up to 180 days for auditing and compliance unless otherwise required by law.

Privacy: Data is processed as per our Privacy Policy. No personally identifiable information is collected unless required for billing or KYC.

7. Availability and Support

API Uptime: Abhirang targets 99.5% uptime excluding scheduled maintenance. However, actual availability may vary.

Support: We offer tiered support plans via email and ticketing. Emergency and SLAs may vary based on subscription.

Maintenance: Scheduled maintenance notices will be sent via email 48 hours in advance.

Third-Party Services: Service uptime may depend on satellite data providers (ISRO, Copernicus, Sentinel, etc.) and Abhirang is not liable for delays caused by them.

8. Intellectual Property

Ownership: Abhirang retains all rights to the technology, algorithms, platform, and data layers.

License to Use: A limited, non-transferable, revocable license is granted to you to ccess and use the API under the scope of your subscription.

Restrictions: You may not relicense, resell, duplicate, or reproduce Abhirang’s services without written permission.

9. Termination and Suspension

By Customer: You may terminate your subscription with 30 days written notice.

By Abhirang: We may suspend or terminate access if:

1. Terms are violated

2. Payments are overdue beyond 14 days

3. Illegal usage or misuse is detected

Post-Termination: Access to the platform and APIs will be revoked. No refund is due for unused credits.

10. Limitation of Liability

No Warranty: Services are provided “as-is” and “as-available.” We do not guarantee availability of specific satellite passes or uninterrupted API responses.

Indirect Damages: Abhirang shall not be liable for any loss of revenue, profits, or data or for any indirect or consequential damages.

Maximum Liability: Abhirang’s liability is limited to the amount paid by you in thepreceding 3 months.

11. Indemnification

You agree to indemnify Abhirang, its officers, and employees from any claims, damages,

or legal actions arising from:

1. Your use of the services

2. Any breach of these Terms

3. Any violation of laws or rights of third parties

12. Modifications and Notifications

We may update these Terms from time to time. Notification of changes will be posted on our platform or emailed to registered users. Continued use constitutes acceptance.

13. Governing Law

These Terms shall be governed by the laws of India. All disputes shall be subject to the courts of Delhi, India.
